Swangerskap

In die volgende paar weke gaan ons kyk na werknemers se regte met betreffende swangerskap. Te dikwels word daar teen swanger vrouens in die werkplek gediskrimineer. Hierdie diskriminasie is heeltemal onaanvaarbaar en werkgewers kom  met hierdie aksies weg omrede die werknemer nie bewus is van haar regte nie.   

Die werklikheid is dat werkgewers dikwels in ʼn moeilike situasies geplaas word weens  die swangerskap van ʼn werknemer.

Soms ontstaan die probleem so vroeg as by die onderhoud fase, waar die werknemer bewus is van haar swangerskap, maar dit nie aan die werkgewer bekend maak nie.

ʼn Ander scenario is waar ʼn huidige werknemer nie die feit dat sy swanger is aan die werkgewer bekend maak nie, tot op die laaste minuut. Uit die aard van die saak plaas dit dan die werkgewer in ʼn ongewenste situasie omdat daar dan op kort kennisgewing ʼn geskikte vervanging gekry moet word sodat die werk kan voortgaan terwyl die werknemer op kraam verlof is.

So wanneer moet ʼn werknemer haar swangerskap bekend maak? Die Wet op Basiese Diensvoorwaardes bepaal dat ʼn werknemer die werkgewer in kennis moet stel ten minste vier weke voordat sy van voorneme is om op kraamverlof te gaan, of indien dit nie moontlik is nie, so gou as wat dit redelikerwys moontlik is.

Daar berus dus geen ander onus op die werkgewer om haar swangerskap om enige ander stadium te verklaar nie.    

In sekere gevalle gebeur dit dat werkgewers selfs die ontslag roete volg.

In een geval is  ʼn werknemer wat op ʼn proeftydperk was ontslaan weens die feit dat die werknemer nie haar swangerskap aan die werkgewer verklaar het ten tye van die onderhoud nie. Heeltemal tereg het die werknemer aangevoer dat sy bang was om haar swangerskap te verklaar vir ingeval sy moontlik nie die pos kan kry as gevolg daarvan nie. Om dieselfde rede was sy bang en het ook nie die feit dat sy swanger is aan haar werkgewer bekend gemaak tydens die proeftydperk nie.

Die werkgewer het aangevoer dat die feit dat sy nie haar swangerskap bekend gemaak het nie, gely het tot ʼn breek in die vertrouens posisie tussen werkgewer en werknemer, en dat die ontslag op hierdie gronde regverdig was.

Oor die algemeen berus die onus om te bewys dat die ontslag regverdig was op die werkgewer, in hierdie spesifieke saak is bevind dat indien die werkgewer bewus is van die feit dat die werknemer verwagtend is, en die werknemer bewys kan lewer dat die ontlag moontlik regstreeks as gevolg van haar swangerskap plaasgevind het die ontslag outomaties onbillik sal wees.

Die werkgewer het deurgaans aangevoer dat die ontlag nie as gevolg van die swangerskap plaasgevind het nie, maar suiwer as gevolg van die skending van die vertrouens verhouding.

Die howe het egter nie met hierdie argument saamgestem nie en bevind dat die werklike rede vir ontslag verband gehou het met die swangerskap van die werknemer. Daar is bevind dat die ontslag outomaties onbillik was.
