Seksuele teistering in die werksplek

Dit is noodsaaklik dat werkgewers ʼn omgewing skep waarin die waardigheid en integriteit van werknemers gerespekteer word. Dit is belangrik dat ʼn klimaat geskep word waar slagoffers van seksuele teistering griewe kan lig sonder dat dit geïgnoreer word of dat hulle onnodig blootgestel word.

Maatskappye moet ʼn beleid instel ten einde seksuele teistering uit te roei sowel as  prosedures daar stel  om  bestuurders/werknemers te weerhou om hulle skuldig  te maak aan sulke onaanvaarbare optrede.  Ten einde te verseker dat die identiteit van al die betrokke persone geheim gehou word moet maatskappye toesien dat griewe oor seksuele teistering sensitief en konfidensieel hanteer en ondersoek word.

Die beleid en prosedure handleiding ten opsigte van personeel van die Universiteit van Stellenbosch definieer seksuele teistering as volg:

Seksuele teistering verwys na gedrag, tipies ondervind as beledigend van aard, waarmee ongewenste seksuele toenadering gesoek word binne die konteks van 'n verhouding van gelyke/ongelyke mag of gesag. Seksuele teistering is 'n vorm van diskriminasie op grond van geslag.  Dit is ongewens, en kan beleef word as 'n uitdrukking van mag, gesag, en beheer van 'n seksuele aard. Dit skep 'n vyandige omgewing, wat die individu se vermoë om te leer en/of te werk belemmer.

Die vakbond Solidariteit beantwoord die vraag “Wanneer is dit seksuele teistering?”, in een van hulle onlangse publikasies as volg: Dit is baie belangrik om tussen seksuele aandag en seksuele teistering te onderskei. Seksuele aandag word seksuele teistering in enige van die volgende situasies:
 As dit volgehou word –hoewel ʼn enkele voorval ook as seksuele teistering beskou kan word.
 As die slagoffer dit duidelik gemaak het dat die gedrag onaanvaarbaar en aanstootlik is en dat die persoon sy gedrag moet staak.
 As die beweerde oortreder moes geweet het dat die gedrag as onaanvaarbaar beskou word.

Seksuele teistering dek ʼn breë spektrum van ongewenste gedrag en sluit onder andere die volgende in:

·         Verbale vorms, soos onwelkome navrae oor ʼn persoon se sekslewe; telefoonoproepe met ʼn seksuele ondertoon; volgehoue growwe of seksistiese grappe of aanmerkings; onwelkome versoeke vir afsprake; opmerkings ten opsigte van ʼn individu se figuur; e-pos van seksuele aard, ensovoorts.

·         Nie-verbale vorms soos gebare met ʼn seksuele betekenis, aangluring (“leering”), onwelkome volgehoue flirtasie, ens.
·         Visuele vorms soos die vertoon van pornografiese materiaal, ens.
·         Fisieke vorms soos onwelkome aanraking, betasting, molestering en verkragting.
·         Quid pro quo-vorms soos seksuele omkopery (byvoorbeeld die belofte van bevordering in ruil vir gunste van ʼn seksuele aard) en seksuele afpersing (byvoorbeeld die weerhouding van bevordering as daar nie aan seksuele versoeke voldoen word nie.)
