Poligraaf Toetse

ʼn Poligraaf word soms ook ʼn leuenverklikker toets genoem.

Poligraaf toetse is ʼn relatiewe nuwe begrip in Suid Afrika, veral met verwysing na die werksverhouding.

Dit is belangrik om daarop te let dat geen persoon verplig kan word om ‘n poligraaf toets te ondergaan nie. Om ʼn persoon te dwing om ʼn poligraaf toets te af te lê is strydig met die Konstitusie van die land. Geen toets mag afgelê word sonder die skriftelike toetemming van die persoon wat die poligraaf toets moet ondergaan nie.

Voorts is dit nodig dat sekere prosedures gevolg by die afneem van die poligraaf toets.

  • Die individu moet in kennis gestel word dat die ondervraging vrywillig is;
  • Slegs vrae wat voor die ondervraging gevra is mag gedurende die ondervraging gebruik word;
  • Die persoon wat ondervra word het die reg op reg op ʼn tolk, indien nodig
  • Indien die persoon wat die toets ondergaan dit verkies moet  ʼn ander persoon teenwoordig  wees ten tye van die ondervraging;
  • Die bovermelde is met dien verstande dat die persoon nie sal inmeng met die verrigtinge nie .

Werkgewers gebruik poligraaf toeste ten einde spesifieke insidente te ondersoek soos byvoorbeeld:

  • In gevalle waar werknemers toegang tot eiendom gehad het wat verband hou met die ondersoek;
  • Waar daar ʼn redelike suspisie of moontlikheid is dat die werknemer betrokke was by die insident;
  • Waar die werkgewer se besigheid sekere ekonomiese verliese gelei het deur  byvoorbeeld diefstal of die beskadiging van eiendom;
  • In gevalle waar die werkgewer ʼn stryd voer teen oneerlikheid in vertrouens posisies;
  •  Waar die werkgewer ʼn stryd voer teen ernstige alkohol gebruik, die onwettige gebruik van verbode of narkotiese middels;
  • Waar die werkgewer ʼn stryd voer teen bedrog binne die maatskappy;
  • Waar die werkgewer ʼn stryd voer teen die opsetlike vervalsing van dokumente en leuens ten opsigte van die identiteit van die betrokke persone

Die uitslae van ʼn poligraaf mag net aan gemagtigde persone bekend gemaak word.

Daar is enkele gevalle waar poligrafiste wel toegelaat is as spesialis getuies in die KBVA.  Die kommissaris het die jurisdiksie en verantwoordelikheid om te besluit of die bepaalde getuies toelaatbaar en betroubaar is, al dan nie.

ʼn Poligraaf mag nie geïnterpreteer word dat skuld geïmpliseer word nie. Dit kan wel as ʼn verswarende omstandigheid dien, veral as daar ook ander bewyse van wangedrag is, met ander woorde dit kan gebruik word om bestaande bewyse te ondersteun.

Werkgewers moet versigtig wees wanneer dit kom by die afneem van poligraaf toetse, die uitslag van die toetse verteenwoordig normaalweg niks anders as hoorsê getuienis nie.
