Openbare vakansiedae

Daar is dikwels onduidelikheid met betrekking tot die betaling en wie in der waarheid kwalifiseer vir openbare vakansiedae.  

Die Wet op Basiese Diensvoorwaardes reguleer die neem van openbare vakansiedae in die werkplek.

Die diensvoorwaardes in artikel 18 is van toepassing op alle werknemers, insluitende permanente werknemers, tydelike werknemers, en werkers wat aangestel is op ʼn spesifieke termyn.

Die verdienste drumpel (earnings threshold) van R 115 572 per jaar, soos deur die minister vasgestel , bepaal dat  werknemers wat  meer as die drumpel verdien alleenlik uitgesluit is van artikel 18 (3). Dit beteken dat die res van die artikel steeds van toepassing is op daardie kategorie werker.

Artikel 18 (3) handel oor die betaling van werknemers wat minder as die drumpel verdien, indien die werknemer op ʼn openbare vakansiedag sou werk op wat hy normaalweg nie sou werk nie.

Dit beteken dat alle werknemers wat meer as die drumpel verdien steeds geregtig is op openbare vakansiedae.

Die bepalings van artikel 18 (1)  is belangrik en die volgende word direk uit die Wet aangehaal  “’n Werkgewer mag nie van ʼn werknemer vereis om op ʼn openbare vakansiedag te werk nie, behalwe ooreenkomstig ʼn ooreenkoms”  Met ander woorde as hulle daarop ooreenkom. Die werker is dus daarop geregtig om die dag af te neem en het nie die werkgewer se toestemming nodig om die dag af te neem met volle betaling nie.

Artikel 18 (2) stipuleer die volgende “Indien ʼn openbare vakansiedag op ʼn dag val waarop ʼn werknemer gewoonlik werk, moet ʼn werkwerkgewer-

(a)   aan ʼn werknemer wat nie op die openbare vakansiedag werk nie, die loon betaal wat die werknemer gewoonlik sou ontvang het vir werk op daardie dag;

(b)   aan ʼn werknemer wat op die openbare vakansiedag werk-

                                I.      minstens dubbel die bedrag in paragraaf (a) bedoel, betaal:  of
                              II.       indien dit groter is, die bedrag in paragraaf (a) bedoel betaal plus die bedrag deur die werknemer verdien vir die tyd op daardie dag gewerk”.

Die werknemer is wetlik daarop geregtig om enige van die dertien dae soos bepaal deur wetgewing (die dae word  normaalweg op kalenders aangedui), af te neem en wat op ʼn dag val wat die werknemer normaalweg sal werk insluitende Goeie Vrydag en Kersdag.

Indien die werknemer op daardie openbare vakansiedag werk moet hy dubbel die normale besoldiging ontvang. Enige betaling vir werk verrig op openbare vakansiedae moet betaal word op die werknemer se normale betaaldag.

Wetgewing maak voorsiening vir 11 amptelike vakansiedae. Alle ander dae soos byvoorbeeld Joodse, Moslem en Hindoe vakansie dae,  asook ander Christen dae soos byvoorbeeld Hemelvaart word nie ingesluit by hierdie ooreenkoms nie.

Ten spyte van die feit moet alle aansoeke van werknemers om enige van die dae af te wees sensitief oorweeg te word.

Aangesien hierdie werknemers ook vir al die ander dae kwalifiseer sal vakansieverlof van toepassing wees.
