Ontslag as gevolg van beserings of ongeskiktheid

Beserings of ongeskiktheid van ʼn ernstige aard kan aanleiding gee tot ontslag. Dit is noodsaaklik dat die spesifieke omstandighede in ag geneem word wanneer daar besluite geneem word rakende die regverdigheid van die ontslag.

Daar moet eerstens bepaal word of die ongeskiktheid permanent of tydelik van aard is. Ten einde te bepaal wat die ernstigheid van die ongeskiktheid is sal die mening van ʼn kundige nodig wees. Menings kan ingewin word ten einde sig of gehoor probleme te bepaal asook om ʼn estimasie te kry rakende die tydperk wat die werknemer afwesig sal wees in gevalle van HIV of kanker.

Die afwesigheid hoef nie noodwendig aanneenlopend te wees nie en kan oor ʼn tydperk plaasvind.

In gevalle van permanente ongeskiktheid moet die werkgewer die volgende moontlikhede oorweeg:

·         Om alternatiewe werk of ʼn alternatiewe pos vir die werker te vind;
·         Om die pligte en werk omstandighede aan te pas ten einde die werknemer te akkommodeer.

Wanneer hierdie oorwegings nie uitvoerbaar is nie sal ontslag moontlik geregverdig kan wees.

In gevalle van tydelike ongeskiktheid moet die werkgewer:  

·         Die ernstigheid van die ongeskiktheid ondersoek;
·         Die werknemer moet gedurende die ondersoek die geleentheid gegun word om  sy kant van die saak te stel;
·         Indien hy dit sou verkies, die geleentheid gegun word om deur ʼn vakbond verteenwoordiger of medewerker verteenwoordig te word.

Dit is belangrik dat ontslag as die laaste uitweg gesien word. Indien die werknemer se ongeskiktheid vir ʼn onredelike lang tydperk sal duur moet alle alternatiewe opsies  oorweeg word in ʼn poging om ontslag te vermy.

Wanneer alternatiewe oorweeg moet die volgende in aanmerking geneem word

  • Aard van die werk;
  • Die tydperk van afwesigheid;
  • Die ernstigheid van die besering/ ongeskiktheid;
  • Die moontlikheid van ʼn tydelike plaasvervanger.

Spesiale pogings moet aanwend word om persone te akkommodeer wat aan diens beseer is, of wat ʼn werkverwante kwaal opgedoen het.

Dit is noodsaaklik dat berading/ raadgewing sessies moet plaasvind voordat enige besluite ten opsigte van alternatiewe poste, verplasing of selfs ontslag geneem word.   

Met enkele uitsonderings is enige werknemer wat ʼn werk verwante besering opgedoen het geregtig op vergoeding. Alle beserings aan diens moet na die vergoedings kommissaris verwys word.  Die vergoeding kommissaris kan gekontak word op die volgende nommers (012) 319 1111, (012) 319 9319 of deur hulle nasionale oproep sentrum te skakel by 0860 105 350.
