Krag onderbrekings (Deel 1)

Baie is al gesê en geskryf oor die huidige elektrisiteit tekort in die land.  Ongelukkig is die werksplek nie immuun teen die probleem nie en affekteer dit elkeen van ons op die een of ander wyse.  

Daar is legio probleme wat met krag onderbrekings gepaard gaan soos dat werknemers partykeer laat vir diens aanmeld en dat werkgewers soms wyer om werknemers te betaal vir die tyd wat die onderbreking geduur het.

Alhoewel daar begrip en simpatie is vir werkgewers ten tye van kragonderbrekings aangesien dit ʼn negatiewe invloed op die produktiwiteit van besighede het wat groot verliese meebring, beteken dit nie dat werknemers nie vir die verlore tyd betaal behoort te word nie. 

Krag onderbrekings is nie die werker se skuld is nie, en hulle kan derhalwe nie daarvoor blameer of gepenaliseer word nie. Alhoewel werknemers nie aktief gedurende kragonderbrekings is nie, het hulle steeds hulle dienste tot die beskikking van die werkgewer gestel en moet hulle daarvoor vergoed word, die verlore ure kan derhalwe nie van hulle salarisse afgetrek word nie.  

Alternatiewe wat soms deur werkgewers oorweeg word gedurende kragonderbrekings het te make met die etenstye en die werk van oortyd ten einde op te maak vir die verlore tyd. 

Vrae wat die afgelope tyd dikwels voorkom is of werkgewers van die werkers kan verwag om hulle etenstye vroeër te neem ten tye van krag onderbrekings, kan hulle versoek word om verlengde etenstye te neem en of daar van werknemers verwag word om langer ure te werk ten einde op te maak vir verlore tyd.

Die  Wet op Basiese Dienvoorwaardes maak voorsiening daaroor dat werknemers 45 ure per week moet werk. Dit beteken 9 ure per dag indien die werker van Maandae tot Vrydae werk. Hierdie kalkulasie sluit etenstye uit. Dit beteken dat die werknemer indirek nie betaal word vir etenstye nie.  In terme van artikel 14 van die Wet  is werknemers geregtig op ʼn etenstyd na elke 5 ure van werk. In terme van dieselfde artikel moet werknemers vergoed word vir enige etenstyd langer 75 minute.

Wanneer dit by die werk van verlengde ure kom het sekere industrie soos byvoorbeeld myne, ongelukkig nie die luukse nie aangesien hulle reeds 24/7 industrieë is en teen volle produksie werk en daar geen kans is dat verlore produksie ingehaal kan word nie. Hierdie werkgewers het ongelukkig geen keuse as om hulle verliese noodgedwonge te aanvaar nie.

Vir ander werkgewers is dit egter moontlik om die skade te beperk en dit te probeer inhaal deur verlengde ure in te stel ten einde verlore produksie in te haal. In hierdie gevalle sal werknemers geregtig wees op oortyd betaling van ten minste 1.5 keer hulle normale tarief. Indien die oortyd op ʼn Sondag gewerk word en die werknemer normaalweg nie op Sondae werk nie, moet oortyd teen ten miste 2 keer die normale uurlikse tarief betaal word.
