Konsiliasie/Bemiddeling

Ek het in vorige rubrieke verwys na die term “Konsiliasie”.

ʼn Konsiliasie verhoor is ʼn proses waar die Kommissaris met die partye vergader om maniere te vind ten einde ʼn ooreenkoms te bereik om die dispuut op te los.   

Konsiliasie maak voorsiening vir die vinnige en regverdige oplossing van dispute.

Die konsiliasie proses is nie ʼn duur en gekompliseerde proses nie, en maak nie voorsiening vir regsverteenwoordiging nie. Die besluit om ʼn ooreenkoms te bereik berus by die partye teenwoordig.

By die konsiliasie sessie mag die werkgewer in persoon verteenwoordig word of mag verteenwoordig word deur ʼn direkteur of ʼn ander werknemer van die  maatskappy. Die werknemer kan verteenwoordig word deur ampsdraer, amptenaar of verteenwoordiger van die werknemer se geregistreerde vakbond.

Die kommissaris sal gewoonlik die verhoor begin deur die partye te vra om inligting te verskaf rakende die dispuut.

Afsonderlike vergaderings tussen die kommissaris en elke party kan ook gehou word. Partye word toegelaat om enige relevante dokumentasie te verskaf wat kan behulpsaam kan wees ten einde meer duidelikheid op die aangeleentheid te gee.      

Tydens hierdie fase is getuies nie noodsaaklik nie. Partye word aangemoedig om inligting te deel en vorendag te kom met moontlike idees ten einde die verskille op te klaar.

Die Kommissaris het ʼn verskeidenheid pligte:

  • Op te bepaal watter roete die verhoor kan aanneem, dit kan mediasie, fasilitering of die maak van aanbevelings insluit ;
  • Die kommissaris is by magte om persone of dokumente te subpoena;
  • Die rol van die kommissaris is om te poog om die dispuut op te los binne 30 dae nadat dit na die CCMA verwys is 

Indien ʼn ooreenkoms bereik is, sal die kommissaris ʼn skikkings ooreenkoms saamstel wat deur beide partye geteken moet word.  

Indien daar  nie tot ʼn vergelyk gekom kan word nie is daar 2 opsies beskikbaar.

Eerstens as die geskil onopgelos bly en die saak het betrekking op ʼn proeftydperk sal die aangeleentheid voortgaan en oorgaan as ʼn Con- Arb proses.

Indien die aangeleentheid betrekking het op diensbeëindiging (wangedrag en swak prestasie/ onbevoegdheid)  of ʼn onbillike arbeidspraktyk en die partye maak nie beswaar daarteen nie, kan die proses voortgaan as ʼn Con-Arb proses. 

Tweedens kan die kommissaris ʼn sertifikaat uitreik wat aandui dat die saak onopgelos is en die applikant moet dan die saak na arbitrasie verwys.

Wanneer ʼn datum van die KBVA ontvang is om ʼn KBVA verhoor by te woon moet die werkgewer nie probeer om die datum te vermy deur uitstel te vra nie.  

Die reëls van die KBVA maak nie voorsiening vir uitstel by konsiliasie nie, en sodanige aansoek sal oor die algemeen nie oorweeg word nie.
