Die betaling van die dertiende tjek

Daar bestaan verskillende tipes bonusse soos byvoorbeeld die dertiende tjek, prestasie bonus, winsdeling ensovoorts.

In hierdie artikel kyk ons spesifiek na die betaling van die dertiende tjek.

Maatskappye betaal gewoonlik werknemers se dertiende tjek gedurende die feestyd of  op die betaaldag van hulle verjaarsdagmaand.

Die wet op Basiese Diensvoorwaardes maak geen melding ten opsigte van die betaling van bonusse nie. Daar rus geen obligasie of wetlike verpligting op werkgewers om bonusse te betaal nie. Met inagneming hiervan moet die uitbetaling daarvan tussen werknemers en werkgewers beding word. Indien die ooreenkoms bepaal dat bonusse wel betaalbaar is vorm dit deel van die werknemer se diensvoorwaardes en moet dit in die dienskontrak ingesluit word.        

Indien werkgewers tradisioneel in die verlede bonusse betaal het, beteken dit nie dat hulle eensydig kan besluit om nie meer enige bonusse uit te betaal nie. Dienskontrakte kan ook nie eensydig verander word nie, aangesien dit soos reeds genoem, deel vorm van die werknemer se diensvoorwaardes. Indien die werkgewer sou besluit om nie voort te gaan met die betaling van bonusse nie, moet daar eers met die werknemers gekonsulteer sowel as ooreengekom word.

In gevalle waar werknemers nie seker is of hulle geregtig is op die betaling nie moet hulle noukeurig na hulle dienskontrakte kyk. Indien die dienskontrak stipuleer dat ʼn bonus as ʼn dertiende tjek betaal word is hulle geregtig daarop en is daar ʼn verantwoordelikheid op die werkgewer om dit te betaal.  

Voorts moet daar gekyk word na die geskiedenis van betaling. In gevalle waar werkgewers tradisioneel bonusse betaal het vir die voorafgaande jare, bestaan daar ʼn moontlikheid dat daar ʼn verwagting by die werker geskep is. Ongeag of hierdie klousule  in die dienskontrak gestipuleer is of nie,  is dit moontlik dat die werker ʼn redelike verwagting kan hê om weereens vir dieselfde bonus te  kwalifiseer.  Die staking van sodanige betalings strek nie net tot nadeel van die werknemer nie , maar is ook onregverdig.

Indien daar enige moontlikheid bestaan dat bonusse nie soos normaalweg uitbetaal sal word nie, moet daar met die werknemers gekonsulteer word. Dit is onaanvaarbaar dat  maatskappye op kort kennisgewing, soms ʼn maand voor die tyd of selfs op die betaaldag die verskoning gebruik dat hulle nie ʼn goeie jaar beleef het nie en sodoende dit nie kan bekostig om bonusse te betaal nie.

Realiteit is dat maatskappye lank voor die betaling van die bonusse tot die besef moes gekom het dat daar nie genoeg fondse gaan wees nie, en die werknemers dienooreenkomstig in kennis moes gestel het.
