Die Beregter vir pensioenfondse

Die kantoor van die Beregter vir Pensioenfondse se doel is om ondersoek in te stel en besluite te neem oor klagtes wat kragtens die Wet op Pensioenfondse voorgelê word. Die  definisie van Pensioenfonds sluit ʼn Voorsorg- en Uittredingsannuïteitsfonds in.

Enige lid, voormalige lid van ʼn pensioenfonds, ʼn begunstigde of voormalige begunstigde, of  ʼn  werkgewer wat deel van die fonds vorm, kan klagtes voorlê 

Die Beregter beskik nie oor regsbevoegdheid oor fondse waartoe die staat finansieel bydra nie.

Kragtens die Wet moet klagtes verband hou met die administrasie van ʼn pensioenfonds, die belegging van die fonds se bates of die toepassing van die fonds se reëls.

Daarbenewens moet die klag een of meer van die volgende bewerings maak:

  • dat die fonds ʼn besluit geneem het wat buite sy bevoegdhede lê;
  • dat die klaer benadeel is as gevolg van wan-administrasie deur die fonds;
  • dat ʼn feite- of regsdispuut ten opsigte van ʼn fonds tussen die fonds of enige persoon en die klaer onstaan het; of;
  • dat ʼn werkgewer wat aan die fonds deelneem nie sy pligte kragtens die reëls van die fonds nagekom het nie.

Wanneer sulke aantygings teen die fonds gemaak word, moet die feite ter ondersteuning van die aantygings en die afleidings wat daaruit maak gemaak word, uiteen gesit word. Dit beteken dat die klaer moet aandui wat werklik gebeur het en hoekom hy van mening is dat sulke optrede    wan-administrasie, oorskryding van magte, ʼn regs- of feitedispuut, of pligsversuim deur die werkgewer verteenwoordig.

Klagtes moet binne drie  jaar vanaf datum wanneer die klag plaasgevind het voorgelê word. Die Beregter kan slegs ʼn verlenging oorweeg indien die klaer ʼn sterk saak het en indien hy daartoe in staat is om goeie redes te verskaf waarom die klag nie binne die voorgeskrewe tydperk voorgelê is nie.    

Alvorens klagtes aan die Beregter voorgelê word moet dit eers skriftelik na die fonds of die werkgewer verwys word. Die fonds of werkgewer moet dan die klag oorweeg en dit binne 30 dae skriftelik beantwoord.

Klagtes kan alleenlik aan die Beregter voorgelê word indien die klaer nie met die terugvoer tevrede is nie, of indien die fonds of werkgewer versuim het om binne 30 dae na die ontvangs van die klag te reageer.

Die Wet op Pensioenfondse moedig klaers aan om eers die klag met die betrokke werkgewer en  die fonds, moontlik deur middel van die administrateur van die fonds, te bespreek ten einde te bepaal of hulle u kan help om die probleem op te los. Die moontlikheid bestaan dat sekere dispute moontlik deur beide partye opgelos kan word sonder dat die Beregter betrokke hoef te raak.
