Arbitrasie

Ons het verlede week gekyk na die meer informele proses van konsiliasie. Arbitrasie is ʼn meer formele proses.

Tydens die verrigtinge (arbitrasie) hoor die kommissaris die eise en teen eise van beide partye aan en besluit op ʼn finale skikkings ooreenkoms in die vorm van ʼn arbitrasie beslissing. Die beslissing word ʼn bevel nadat beide partye aangehoor is en is wetlik biddend op die partye.

Gedurende die verrigtinge mag die partye bewyse voorlê, getuies roep en die ander party se getuies ondervra.   

Om uitstel te kry op arbitrasie is ʼn omvattende, moeilike en tydrowende proses en kan nie net as vanselfsprekend aanvaar word nie. Uitstel sal slegs gegee word indien dit voldoen aan KBVA reël 23. Dit is noodsaaklik dat beide partye skriftelik instem tot die uitstel. Die versoek om uitstel moet die KBVA ten minste 10 dae voor die verhoor bereik.

Die werkgewer mag homself  in persoon by die CCMA verteenwoordig of verteenwoordig word deur ʼn regsverteenwoordiger,  ʼn direkteur of werknemer van die maatskappy. Die werknemer kan verteenwoordig word deur ʼn regsverteenwoordiger,  ampsdraer, amptenaar of verteenwoordiger van die werknemer se geregistreerde vakbond.

Dit is belangrik dat die partye die bewyse wat voorgelê gaan word voorberei voor die tyd en seker maak dat die voorleggings duidelik en spesifiek is. Getuies wat nodig mag wees om die saak te ondersteun moet voorberei word en daar moet seker gemaak word dat die getuies beskikbaar sal wees op die datum van die verhoor. 

Wat gebeur as die ander party nie die arbitrasie bevel eerbiedig nie?

ʼn Arbitrasie bevel ten opsigte van vergoeding wat deur die kommissaris uitgereik word is finaal en bindend en kan afgedwing word deur die KBVA Direkteur. Dit beteken dat die KBVA by magte is om ʼn arbitrasie beslissing ʼn “hof bevel” te maak.

Indien die ander party nalaat om die ooreenkoms na te kom moet die applikant die vorm 7.18 voltooi. Die Direkteur van die KBVA moet dan die bevel sertifiseer as ʼn hofbevel.

Hierdie vorm moet dan na die Registrateur van die Arbeidshof geneem word ten einde ʼn lasbrief aan die Balju uit te reik ten einde uitvoering daaraan te gee.

In die geval van beslissings deur ’n Bedingingskamer , moet die applikant die vorm LRA 7. 18 A invul en dieselfde prosedure volg soos uiteengesit.

Vir die afdwingbaarheid van enige ander gesertifiseerde bevele soos byvoorbeeld waar dit nie betrekking het op die betaling van vergoeding nie, kan die applikant geregtelike stappe neem in die arbeidshof met betrekking tot minagting van die hof

Die sertifiserings bevele is so saamgestel dat dit die afdwingbaarheid van die verpligtinge wat daarmee gepaard gaan te bespoedig
