Waarskuwings

Die tipe waarskuwing van toepassing sal afhang van die ernstigheid van die oortreding sowel as die omstandighede waaronder die oortreding plaasgevind het. Die dissiplinêre kode dien as ʼn riglyn ten opsigte van wanneer ʼn spesifieke waarskuwing ten opsigte van verskillende oortredings gegee moet word. Vir minder ernstige oortredings sal ʼn mondelingse waarskuwing van toepassing wees en ʼn skriftelike oortreding vir ʼn meer ernstige oortreding.

 

Met inagneming van die aard en ernstigheid van oortredings moet daar gelet word op die progressiewe aard van waarskuwings. Afhangende van die oortreding soos in gevalle van byvoorbeeld om nie betyds vir diens aan te meld nie, sal die dissiplinêre kode ʼn aanduiding gee van watter sanksie toegepas behoort te word byvoorbeeld ʼn mondelinge waarskuwing vir die eerste, ʼn skriftelike waarskuwing vir die tweede, ʼn finale skriftelike waarskuwing vir die derde oortreding ensovoorts.

 

Die oogmerk van ʼn waarskuwing is nie alleenlik om te dien as straf nie, maar ook om te dien as ʼn instrument ten einde gedrag te verbeter. By herhaling sal ʼn meer ernstige sanksie van toepassing wees. Arbeidswetgewing spesifiseer nie presies hoe lank ʼn waarskuwing geldig moet wees nie, maar die aanvaarbare tydperk is gewoonlik 3 maande vir ʼn mondelingse waarskuwing, ses maande vir ʼn skriftelike waarskuwing en ʼn periode van tussen 9 en 12 maande vir ʼn finale waarskuwing.

 

Ten spyte van die feit dat ʼn mondelinge waarskuwing presies beteken wat die naam aandui en dit verkieslik nie op persoonlike lêers geliasseer moet word nie, is dit steeds noodsaaklik om dit te dokumenteer. Toesighouers kan bloot ʼn aantekening of nota in hulle dagboeke maak en die werknemer langsaan laat teken. Indien die werknemer weier om te teken kan ʼn mede- bestuurder ingeroep word ten einde te teken as 'n getuie. Voormelde sal 'n situasie voorkom waar werknemers ontken dat hulle wel voorheen mondelinge waarskuwings ontvang het.

 

ʼn Waarskuwing moet die volgende inligting bevat. Die identiteit van beide partye, die aard van die oortreding sowel as die datum en tyd van die oortreding, die voorwaardes van die oortreding sowel as die tydsduur, ʼn duidelike aanduiding van wat van die oortreder verwag word ten einde die situasie reg te stel en ʼn duidelike indikasie van die nagevolge indien die gedrag nie verbeter word nie. Dit is noodsaaklik dat alle werknemers ten alle tye regverdig gehanteer word. Elke situasie is uniek en ten einde regverdig of konsekwent op te tree moet elke situasie op meriete hanteer word.
