Verlof vir gesinsverantwoordelikheid

Verlof vir gesinsverantwoordelikheid is van toepassing op werknemers wat vir langer as vier maande en vir ten minste vier dae per week vir die werkgewer werk. Met die uitsondering van huiswerkers wat vir ʼn periode van 5 dae kwalifiseer, is gesinsverantwoordelikheidsverlof 3 dae. Hierdie verlof is addisioneel tot enige ander verlof waarvoor die werknemer mag kwalifiseer soos bv. siekte- en vakansie verlof. Die verlof word gebaseer op ʼn 1 jaar siklus vanaf Januarie tot Desember. Indien geen verlof geëis is gedurende die verlof siklus nie, verstryk dit en kan dit nie oorgedra word na die volgende jaar nie.

 

Hierdie verlof kan geneem word vir ʼn volle of ʼn gedeelte van ʼn dag. Die verlof is slegs van toepassing in die volgende gevalle: wanneer die werknemers se kind gebore word, wanneer die werknemer se kind siek is, in die geval van afsterwe van die werknemer se lewensmaat, ouer, grootouer, kind, aangenome kind , kleinkind, broer of suster.  Die bogenoemde definisie maak nie voorsiening vir gevalle van siekte van ʼn eggenoot of lewensmaat nie, maar slegs in die geval van siekte van 'n kind. In terme van die betrokke wet word ʼn kind gedefinieer as ʼn persoon onder die ouderdom van 18 jaar.

 

Gesinsverantwoordelikheid verlof beteken nie ʼn werknemer kwalifiseer vir die periode van 3 dae elke keer wanneer ʼn voorval plaasvind nie, maar is van toepassing op die hele periode van 12 maande. Die werknemer moet in gedagte hou dat die werkgewer sekere operasionele vereistes het en sekere rëelings moet tref indien ʼn persoon om sekere redes nie vir diens kan rapporteer nie. Dit bly steeds die verantwoordelikheid van die werknemer om die werkgewer in kennis te stel van situasies wanneer ', periode van verlof geneem kan word.

 

Die blote feit dat ʼn werknemer vir die verlof kwalifiseer beteken nie noodwendig dat die persoon net van die werk kan wegbly nie. Werkgewers is geregtig om tugstappe te neem in terme van die dissiplinêre prosedure in situasies waar werknemers bloot wegbly net omdat daar ʼn persepsie bestaan dat hulle geregtig op die voordele is.  Ten einde te verseker dat die verlof geneem word vir die doeleindes soos bespreek, is die werkgewer geregtig om te vra vir redelike bewyse soos bv. ʼn mediese sertifikaat en geboorte sertifikate alvorens betaalde verlof vir gesinsverantwoordelikheid toegestaan word.
